Important Clauses on the Lease Contract
As stated previously it is important that the lease contract is studied and read not only through the course of this program but after until it is known completely.
Everything on a lease contract is important but certain clauses are more important than others.
Below you will find a Summary of the Lease Contract.
Clauses are grouped based on the Topic:
First is the Parties: Here you write all of the occupants above the age of 18 that will be living in the apartment. *Everyone above the age of 18 is considered a leaseholder.*
- Remember everyone listed must have had an application. (if an application was not done then the person can no be listed on the lease nor can they live on the property)
Occupants: Here we only list all the occupants that will be living in the apartment below the age of 18.
(The space is only for children, not for adults)
No Adult should be listed on this space
Right below both of these spaces there is a clause that explains:
The premises may not be occupied by more than 4 unrelated persons: two heartbeats per bedroom. Persons not listed above cannot stay overnight without informing the office and without written permission from the office. Resident(s) who violate this rule by having unauthorized occupant(s) in their apartment, will be charged $100.00 per day for each day the unauthorized occupant(s) is in the apartment; and will be subject to immediate eviction. Resident(s) cannot, under any circumstances, give permission for any person(s) not listed above, to occupy the apartment as an occupant(s) and/or as a Resident(s). For and in consideration of the covenants and obligations contained herein and other good and valuable consideration, the receipt and sufficiency of what of which is hereby acknowledged, the parties hereto hereby agree as follows.
Please read all sections carefully.
Clause #1 Property:
In this clause, you will have to put the address of the apartment the tenant is going to be moving into, as well as the address.
- As stated before some apartment complexes have many different addresses. It is important that in this clause you write the correct address about the apartment number.
This clause is important because this is the apartment the tenant is legally signing the lease for.
*If by any chance the apartment number changes then the lease contract will have to be redone.
Clause #2 Lease Contract Term:
The Start and end date of the lease contract will be written here. As stated before these are the most important dates on the lease contract.
- This should be the exact date the tenant is getting the keys.
- The end date should be 12 months after the start date but on the last day of that month.
All Bills Paid
These clauses will list all of the utilities that are covered under this lease contract, the details, and their terms.
